Privacy Policy

 

We at Mackey, LLC (Doing Business As “SecureVision”; hereafter “SecureVision,” or “we”) along with our subsidiaries and affiliates, respect your concerns about privacy. This Privacy Notice describes the types of personal information we collect on the SECUREVISION websites (the “Sites”), how we may use the information and with whom we may share it. The notice also describes the measures we take to safeguard the personal information. In addition, we tell you how you can ask us to (i) access or change the personal information we maintain about you, (ii) refrain from sending you certain communications, and (iii) answer questions you may have about our privacy practices.

The purpose of the document is:

• to describe the guiding principles followed by SECUREVISION in terms of processing personal data;

• to make known the following internal procedures in accordance with the rights of the data subjects:

Procedure for Risk Assessment on Data Protection;

Procedure for informing the data subjects;

Procedure for data retention, updating, restriction and deletion;

Procedure in case of a request for Information from the concerned person;

Marketing Procedure;

The procedure in the event of a security breach;

• to make known the existence of a domestic security policy through which adequate technical and organizational measures are in place to protect personal data against accidental or unlawful destruction, loss, modification, disclosure or unauthorized access;

• to disclose the rights of individuals concerned with the processing of personal data;

Guiding principles on the processing of personal data

Rightness

SECUREVISION collects and processes personal data in a fair and legitimate manner.

Relevance

SECUREVISION collects and processes only personal data that is relevant and necessary for a particular purpose. Personal data will not be processed in a manner incompatible with the purpose for which they were collected. Personal data that is not appropriate or relevant to the purpose for which it was collected will not be processed.

Accuracy

SECUREVISION assumes responsibility for the processing and storage of personal data in an accurate manner, updated for the legitimate purpose in which it was collected.

Disclosure

Disclosure of personal data will only be done in a manner consistent with the purpose for which personal data has been collected.

Security and compliance

SECUREVISION, together with its collaborators and affiliates, assumes responsibility for the implementation of appropriate technical and organizational measures regarding the protection of confidentiality and security of collected personal data.

At the same time, SECUREVISION, together with its collaborators, assumes responsibility for implementing policies, guides, instructions to demonstrate the processing of personal data according to the legal standards in force.

Access

SECUREVISION grants access to personal data, to its employees, affiliates and collaborators only in accordance with the stated purpose of data collection.

Responsibility

All SECUREVISION employees, collaborators, and service providers who are in contact with personal data must act in accordance with the principles of this privacy policy.

 

You may choose to provide personal information (such as name and contact details as listed below) through our Site. The types of personal information you may provide include:

  • Individual and business contact information (such as name, physical address, email address, and telephone or fax number)

  • Prior addresses and length of time at each address

  • Username and password to access the Site

  • Citizenship and work authorization status

  • Driver's license number, driving history and other details about government-issued identification documents

  • Education history

  • Employment and salary history

  • Military service information

  • Resume or C.V.

  • Age range and date of birth

  • Language proficiency

  • Criminal record information

  • Other information about your qualifications

  • Requests for disability accommodations

If you apply for a U.S.-based position, you may provide information on your gender, race or ethnicity on a voluntary basis. SecureVision will not consider either this information or your choice to decline to provide it in evaluating your qualifications for employment with us. We may use this information to the extent necessary or appropriate for compliance with relevant legal or contractual obligations and for other internal purposes.

Rights of data subjects (according to GDPR - applicable to European citizens)

Persons concerned with the processing of personal data by SECUREVISION have the following rights in relation to the company:

4.1 Right of access

Represents the right of the data subject to obtain a confirmation from the operator that he or she does or does not process the personal data concerning him / her and, if so, access to the data and specific information regarding the processing process.

4.2 Right to data portability

It refers to the right to receive personal data in a structured format, which is currently used and can be read automatically, and to the right to transmit these data directly to another operator, if technically feasible. The right to data portability applies only if the processing of data is "done by automatic means", so that it does not cover most papers on paper, so this right must be taken into account solely in terms of data processed through electronic means.

4.3 The Right to Opposition

It assumes the right of the data subject to oppose the processing of personal data when processing is not necessary for the performance of a task that is in the public interest or when the operator's legitimate interest is not taken into account. Where the processing of personal data is for the purpose of direct marketing, the data subject is primarily entitled to oppose processing at any time.

4.4 Right to rectification

It refers to the correction of inaccurate personal data stored. The rectification must be communicated to each recipient to whom the data was transmitted, unless this proves impossible or involves disproportionate efforts.

4.5 Right to delete data ("the right to be forgotten")

Involves the data subject's right to request the deletion of his personal data if one of the following reasons applies: they are no longer necessary for the purposes for which they were collected or processed; the data subject withdraws his / her consent and there is no other legal basis for the processing; the data subject opposes the processing and there are no legitimate reasons to prevail over his / her application; personal data has been processed illegally; personal data must be deleted for compliance with a legal obligation;

4.6 Right to Restrict Processing

It is exercised if the person challenges the accuracy of the data, for a period that allows verification of the correctness of the data; processing is illegal and the person opposes the deletion of personal data, but instead calls for restriction; if the operator no longer requires personal data for processing, but the person requests them for the establishment, exercise or defense of a right in court; if the person opposed the processing for the period of time that it is verified that the legitimate rights of the operator prevail over the person's rights.

In addition, when you visit our Site, we may collect certain information by automated means, such as cookies and web beacons. The information we collect in this manner includes IP address, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken on the sites, and dates and times of website visits. A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon,” also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server. Through these automated collection methods, we obtain “clickstream data,” which is a log of content on which a visitor clicks while browsing a website. As the visitor clicks through the website, a record of the action may be collected and stored. We may link certain data elements we have collected through automated means, such as your browser information, with other information we have obtained about you to let us know, for example, whether you have opened an email we sent to you. We also may use third-party website analytics tools that collect information about visitor traffic on the Site. Your browser may tell you how to be notified when you receive certain types of cookies or how to restrict or disable certain types of cookies. Please note, however, that without cookies you may not be able to use all of the features of the Site. 

The providers of third-party apps, tools, widgets and plug-ins on the Site, such as third-party login services and Facebook “Like” buttons, also may use automated means to collect information regarding your interactions with these features. This information is subject to the privacy policies or notices of these providers.

HOW WE USE YOUR INFORMATION

We may use the information we obtain to:

  • Provide applicant support and respond to and communicate with you about your requests, questions and comments

  • Establish and manage your Site account

  • Evaluate you for available positions

  • Obtain background check information

  • Contact you regarding possible employment

  • Operate, evaluate and improve our business

  • Perform data analyses

  • Protect against, identify and prevent fraud and other criminal activity, claims and other liabilities

  • Comply with applicable legal requirements and our policies

In addition, we use information collected online through cookies, web beacons and other automated means for purposes such as (i) customizing our users’ visits to our websites, (ii) delivering content tailored to our users’ interests and the manner in which our users browse our websites, and (iii) managing our business. We also use this information to help diagnose technical and service problems, administer our websites, identify users of our websites, and gather demographic information about our users. We use clickstream data to determine how much time users spend on web pages of our websites, which websites they come from, how users navigate through our websites, and how we may tailor our websites to better meet the needs of our users.

We also may use the information we obtain about you in other ways for which we provide specific notice at the time of collection.

 

INFORMATION WE MAY SHARE

We do not sell or otherwise share personal information about you, except as described in this Privacy Notice. We may share the personal information we obtain with our affiliates for the purposes described in this Privacy Notice. We also share personal information with third parties who perform services on our behalf based on our instructions. These third parties are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements.

Information collected through third-party apps, tools, widgets and plug-ins (such as information obtained through third-party login services or relating to your use of a Facebook “Like” button) is collected directly by the providers of these features. This information is subject to the privacy policies of the providers of the features, and SecureVision is not responsible for those providers’ information practices.

We also may disclose information about you (i) if we are required to do so by law, regulation or legal process (such as a court order or subpoena), (ii) in response to requests by government agencies, such as law enforcement authorities, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity. We reserve the right to transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution or liquidation).

 

YOUR OPTIONS

We offer you certain choices about how we communicate with you and what information we collect from you. If you visit the job application tools on our Site, you may update the personal information you have submitted there by visiting the profile section of your account or, for a limited time, revising an application. You also may contact us as described in the “How to Contact Us” section below to submit requests, update your preferences, or ask us to remove your information from our mailing lists pursuant to applicable law.

If you inquire about employment with SecureVision and provide personal information about yourself (such as your address, telephone number and Social Security number), SecureVision is legally obligated to maintain such information in accordance with applicable law, including the record-keeping obligations established by the Office of Federal Contract Compliance Programs and the Equal Employment Opportunity Commission. Once your personal information is submitted to SecureVision, we will not be able to grant a subsequent request to delete such personal information from our systems during the legally required record retention period.

 

MODIFYING AND DELETING YOUR PERSONAL INFORMATION

You may access the information we hold about you. If you wish to exercise this right, please contact us using the details in the How To Contact Us section below. If you would like to update, correct, modify or delete from our database any personal information you previously submitted to us, please let us know by accessing and updating your profile. If you delete certain information, you may not be able to order services in the future without re-submitting such information. We will comply with your request as soon as reasonably practicable. Also, please note that we will maintain personal information in our database whenever we are required to do so by law.

Please note that we may need to retain certain information for record-keeping purposes and/or to complete any transactions that you began prior to requesting such change or deletion. We will retain your personal information for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law.

 

CONSENT TO TRANSFER

We are a global company and have databases in different countries.  We may transfer your data to one of our databases outside your country of domicile, potentially including countries which may not require an adequate level of protection for your personal information compared with that provided in your country.  By using the Site or providing us with any information, you consent to this transfer, processing, and storage of your information in a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside or are a citizen. We will take all steps reasonably necessary to ensure that your data is treated securely and by this Privacy Policy.


RETENTION OF DATA

The personal information is kept for the time necessary to provide the business service requested by the user, stated by the purposes outlined in this document, and then you can always request that SecureVision suspend or remove the data.


CHILDREN
 

The services are intended for a general audience and are not intended for and may not be used by children under the age of 13. We do not knowingly collect information from children under the age of 16 and we do not target the Services to children under the age of 16. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us using the details in the How To Contact Us section below. We will delete such information from our files as soon as reasonably practicable.


CALIFORNIA RESIDENTS – PRIVACY RIGHTS

As stated elsewhere in this Privacy Policy, we do not share personal information with third parties for their direct marketing purposes, as defined by California Civil Code Section 1798.83, unless we give you a choice (opt-in or opt-out) before sharing with those third parties.

Please note that we will not accept inquiries via the telephone or by facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.

 

CHANGES

We reserve the right, at our sole discretion, to modify or replace this Policy at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. 

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using our service. 

DATA SECURITY

We have implemented commercially reasonable security measures to help protect your personal information from loss, misuse, or unauthorized access or disclosure; unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Information, we cannot ensure its security. You use the Services and provide us with information on your initiative and risk. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us of the problem by contacting us using the details in the Contact Us section below.
